Current Mandatory Vaccination Regulations by State, Q3 of 2021 - Zupnick Associates

As of quarter three, 2021, about 25 states require vaccinations for various employee categories. The majority of these states stipulate that employees are either vaccinated, or tested regularly if, unvaccinated. About 21 states have specific vaccination requirements for healthcare employees.

Six states require mandatory vaccinations failure to which employees should be terminated. But they’ve exempted healthcare workers from vaccination if their religious beliefs or medical condition don’t permit it.

Thirteen states have state laws that ban employers from enforcing mandatory vaccinations in the workplace.

South Carolina, Michigan, and Ohio are coming up with vaccine mandates for state workers.

This guide breaks down the current mandatory vaccination regulations by state, Q3 of 2021. These laws are not federal laws as they apply to specific states only.

 

Arizona

It has banned vaccine mandates for all employees except healthcare workers. Healthcare employers can require vaccination or testing for their employees.

Arkansas

It has banned vaccine mandates for only state healthcare employees.

Colorado

The state mandates vaccination or termination of healthcare workers in all healthcare settings. It also applies to all congregate and high-risk living settings.

California

The state mandates vaccination or testing of healthcare workers in all healthcare settings. It also applies to all congregate and high-risk living settings.

Connecticut

The state mandates vaccination or testing of healthcare workers in long-term care or nursing homes.

District of Columbia

The state mandates vaccination or testing of healthcare workers in all healthcare settings.

Delaware

The state mandates vaccination or testing of healthcare workers in all healthcare settings.

Florida

It has banned vaccine mandates for all employees in the public and private sectors. A violation of the ban carries a fine of $10,000 per employee.

Georgia

It has banned vaccine mandates for only state healthcare employees.

Idaho

It has banned vaccine mandates for only state employees.

Indiana

It has banned vaccine mandates for only state healthcare employees.

Illinois

The state mandates vaccination or testing of state healthcare workers only.

Kentucky

The state mandates vaccination or testing of state healthcare workers only.

Kansas

It has banned vaccine mandates for all employees in the public and private sectors.

Maryland

The state mandates vaccination or testing of state healthcare workers only.

Maine

The state mandates vaccination or termination of healthcare workers in all healthcare settings.

Massachusetts

The state mandates vaccination or testing of healthcare workers in long-term care or nursing homes.

Mississippi

The state mandates vaccination or testing of healthcare workers in long-term care or nursing homes.

Montana

It has banned vaccine mandates for all employees except healthcare workers. Healthcare institutions can ask their staff to share vaccination status, and anyone who doesn’t may be assumed unvaccinated. They need to offer reasonable accommodation to the unvaccinated.

New Hampshire

It has banned vaccine mandates for only state healthcare employees unless there’s a direct threat that can’t be solved by other means.

North Dakota

It has banned vaccine mandates for only state healthcare employees.

New York

The state mandates vaccination or termination of healthcare workers in all healthcare settings.

Nevada

The state mandates vaccination or testing of state healthcare workers only.

New Jersey

The state mandates vaccination or testing of healthcare workers in all congregate and high-risk living settings.

New Mexico

The state mandates vaccination or testing of healthcare workers in all healthcare settings.

North Carolina

The state mandates vaccination or testing of state healthcare workers only.

Oregon

The state mandates vaccination or termination of state healthcare workers only. It also requires vaccination to be done before the deadline or six weeks after full FDA approval; the later date.

Pennsylvania

The state mandates vaccination or termination of healthcare workers in all healthcare settings. It also applies to all congregate and high-risk living settings. All new employees are to be vaccinated before starting work.

Rhode Island

The state mandates vaccination or termination of healthcare workers in all healthcare settings.

Tennessee

It has banned vaccine mandates for only state healthcare employees.

Texas

It has banned vaccine mandates for all public and private sector employees.

Utah

It has banned vaccine mandates for only state healthcare employees.

Vermont

The state mandates vaccination or testing of state healthcare workers only.

Washington

The state mandates vaccination or termination of healthcare workers in nursing homes.

Wisconsin

The state mandates vaccination or testing of state healthcare workers only.
